The Supreme Court Bows to Political Power: The Rule of Law No Longer Exists in Mexico

Grupo Salinas warns that Mexico’s Supreme Court acts under political pressure, denounces judicial bias, and reaffirms its commitment to defend its rights before national and international bodies.

For a long time, we have warned —as have many others in Mexico— that the so-called judicial reform, along with its electoral

farce, was created to give the ruling party total control of the State, putting an end to the Rule of Law. That is precisely what is happening today.

We are now witnessing a justice system corrupted and guided by political orders rather than by law or democratic values. Even worse, we have an illegitimate Supreme Court composed of Ministers subjugated to political pressure, submissive to the interests of those in power, and intent on dismantling fundamental guarantees such as the figure of amparo—a legal instrument that allows citizens to defend themselves from State abuse.

In our case, the President’s office has orchestrated a systematic campaign —by both Andrés Manuel López Obrador and Claudia Sheinbaum— aimed at pressuring and coercing the Ministers into ruling according to political convenience. The more than 280 mentions against us in their public statements are, among other things, a clear demonstration of this persecution.

In the coming days, this distortion of the justice system will be confirmed when the Ministers rule on some of our companies’ cases, doing so in alignment with this new political agenda. On that day, all citizens will witness the end of the judiciary as a true counterbalance and a useful instrument of justice.

This group of Ministers —some pressured and forced by the Executive, others driven by ideological bias and clear prejudice against us—will issue resolutions lacking legal logic, constitutional adherence, or respect for the Rule of Law. Their decisions

will follow scripts dictated by the President’s office, validating extortion from tax authorities that include double charges and absurd calculations of surcharges and fines. Such rulings would set a precedent allowing the imposition of tax credits without guaranteeing taxpayers their right to a fair hearing.

The obscure strategy of the Court to decide cases on a fast-track basis without prior analysis is evident: the last-minute, late-night inclusion of our cases in Friday’s official agenda, even revealing the outcome of their rulings in advance. Regardless of what they claim, this confirms that justice and the Rule of Law no longer exist in Mexico.

In response to this blatant violation of our rights, we state the following:

• We have always been willing to pay what is fair and correct, according to the tax authorities’ own resolutions and court rulings, which clearly establish that double taxation is not applicable. What we will never do is yield to abusive, unconstitutional, and immoral double charges fabricated by the authorities with a clear political intent: to silence us simply because we think differently, express our opinions, and, whether they like it or not, tell the truth.

• These court rulings are not final. As they violate fundamental human rights such as due process, the right to be heard, and the right to legality, we will continue our legitimate legal defense in multiple forums and will initiate actions before international instances such as the Inter-American Court of Human Rights.

• Once again, we urge the tax authorities to correctly quantify the amount of our tax credits according to law—without double collection and eliminating the exorbitant surcharges—so that we may proceed to settle them properly.

• Finally, we are evaluating the filing of a lawsuit against the officials responsible for deliberately remaining silent and denying our constitutional right of petition, as well as for violating our human right to prompt and effective justice.

To everyone in Mexico, let us be clear: no matter the political pressure, selective justice, or attempts to silence us—we are here, and we will continue to be here for many years to come.
